Welcome to Nibango. By accessing or using the Nibango mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By registering, you represent that you meet this requirement.

2. Your account

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must provide accurate, current information when creating your account.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately if you suspect unauthorized access.

3. Acceptable use

You agree not to:

  • Post illegal, fraudulent, misleading, or prohibited content.
  • Infringe the intellectual property or privacy rights of others.
  • Harass, threaten, or otherwise abuse other users.
  • Use the Service for money laundering, scams, or any illegal activity.
  • Attempt to access other users' accounts or our systems without authorization.
  • Use bots, scrapers, or automated tools without our express permission.

4. Listings and transactions

  • Nibango is a marketplace platform that connects buyers and sellers. We are not a party to transactions between users.
  • Sellers are solely responsible for the accuracy of their listings and the legality of the items offered.
  • Buyers should exercise due diligence before completing any purchase.
  • We reserve the right to remove listings that violate these Terms or applicable law.

5. Fees and payments

Basic listing and use of the Service is free. We may offer optional paid features (e.g., promoted listings). Fees for paid features will be clearly disclosed before purchase and are processed through our payment provider (Stripe). Refund policies for paid features will be stated at the time of purchase.

6. Content you post

  • You retain ownership of the content you post (images, descriptions, messages).
  • By posting content, you grant Nibango a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Service.
  • You represent that you have the right to post the content and that it does not violate any third-party rights.

7. Prohibited items

You may not list items that are illegal to sell in your jurisdiction, including but not limited to: weapons, drugs, stolen goods, counterfeit products, hazardous materials, and items that infringe intellectual property rights. 8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Intellectual property

The Service, including its design, logos, and software, is owned by Nibango and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our permission.

10. Termination

  • You may delete your account at any time through the app settings.
  • We may suspend or terminate your account if you violate these Terms, with or without notice.
  • Upon termination, your right to use the Service ceases, but provisions that by nature should survive (e.g., liability, indemnity) will remain in effect.

11. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of any listing or user. We are not responsible for the quality, safety, or legality of items listed.

12. Limitation of liability

To the maximum extent permitted by law, Nibango shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service or any transaction between users.

13. Indemnification

You agree to indemnify and hold Nibango harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Governing law

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain.

15. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
